These Terms & Conditions (the 'Terms') govern your access to and use of Unlimited AI Images - Magical, an online AI photo editor available at https://magicalstudio.ai (the 'Service'). By accessing or using the Service, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By creating an account, signing in, or otherwise using Unlimited AI Images - Magical, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using Unlimited AI Images - Magical, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Your Account

You sign in to Unlimited AI Images - Magical using Google sign-in. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorized use. You may not share your account or use another person's account without permission.

4. Acceptable Use & Prohibited Content

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for the content you upload and the results you generate. You must not upload, create, or share:

  • Content that is illegal or violates any applicable law or regulation.
  • Content that infringes the intellectual property, privacy, or other rights of any person.
  • Non-consensual content, including images of other people used or altered without their permission.
  • Sexually explicit content involving minors, or any content that exploits or endangers children.
  • NSFW content: sexually explicit, pornographic, nude, or otherwise adult content of any kind, whether uploaded, described in a prompt, or generated as a result.
  • Deepfake content: synthetic media depicting real, identifiable individuals in fabricated situations, or any content that impersonates a real person without their explicit consent.
  • Face swaps: replacing, transferring, or superimposing any person's face onto another person's image or video. The Service does not offer face-swap functionality and any attempt to achieve it is prohibited.
  • Harmful, abusive, harassing, defamatory, hateful, or otherwise objectionable content.
  • Content intended to deceive, defraud, impersonate, or mislead others.

The Service enforces these rules with automated moderation: every prompt is screened by a text-moderation model, and every uploaded image and every generated result is screened by an image-safety model before it is delivered. Content that fails these checks is blocked and never shown, and accounts that repeatedly attempt prohibited content may be restricted or terminated.

You also agree not to misuse the Service, including by attempting to bypass usage limits, reverse engineer the Service, interfere with its operation, or access it through automated or unauthorized means.

You are solely and fully responsible for every image you generate and for how you use it. The Service is a creative tool, you provide the inputs and prompts and you decide what to create and where to share it. While Unlimited AI Images - Magical applies automated safety filters to prompts, uploads, and generated results, it does not otherwise monitor, review, endorse, or control the images you generate and is not responsible or liable for any image you create or for any misuse of the Service or its outputs, including but not limited to blackmail, extortion, harassment, bullying, defamation, impersonation, fraud, the creation of non-consensual, deceptive, or explicit imagery, or any other unlawful or harmful use. Any such misuse is your responsibility alone. You agree to indemnify, defend, and hold harmless Unlimited AI Images - Magical and its affiliates from and against any claims, damages, losses, or liabilities arising out of or related to the images you generate or your use of the Service.

5. User Content & Rights

You retain ownership of the photos and other content you upload to Unlimited AI Images - Magical ('User Content'). We do not claim ownership of your uploads. You represent and warrant that you own or have all necessary rights to the content you upload and that its use through the Service does not violate any law or third-party rights.

To operate the Service, you grant us a limited, non-exclusive, worldwide license to host, store, process, and transform your User Content solely for the purpose of providing the AI editing features you request (such as Ghibli styling, background removal, colorize, enhance, upscale, and trends) and operating and improving the Service. This license ends when your content is deleted, except where retention is required by law.

6. Intellectual Property

The Service, including its software, design, branding, text, and features, is owned by Unlimited AI Images - Magical and protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights, title, and interest in and to the Service. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

7. Subscriptions & Billing

Unlimited AI Images - Magical gives every account a free allowance of 5 images a day. Unlimited images come with an 'Unlimited' subscription, which you may purchase on a weekly or monthly basis. Payments are processed securely through Dodo Payments.

  • Subscriptions automatically renew at the end of each billing period until you cancel.
  • The plans include unlimited images: text to image and image to image, on every AI tool, style and trend. AI video is not part of the plans.
  • The Weekly plan is $9.99 a week, and its first payment is charged at checkout.
  • The Monthly plan is $29.99 a month and starts with a 1-day trial for $1.99, once per account and not with a discount code. The $1.99 is charged at checkout. Unless you cancel before the trial ends, the plan continues at $29.99 a month from day 2.
  • Prices are in US dollars and exclude applicable taxes; the total for your country is shown at checkout.
  • You can cancel anytime in Settings → Plan → Cancel; your plan remains active until the end of the current paid period.
  • To change plans, cancel your current plan first; it remains active until the end of the current paid period. Then purchase the new plan.
  • Prices may change; we will give you notice before any change applies to your subscription.

8. Cancellations & Refunds

You may cancel your subscription at any time from Settings → Plan → Cancel. Cancelling stops all future billing so you will not be charged again. You can request a full refund within 24 hours of the first payment of a Monthly or Yearly plan, if you have made 5 or fewer generations since that payment. Weekly plans, trial fees and renewals are not refundable. After 24 hours a payment is final and non-refundable, including partial or unused time. See our Cancellation & Refund Policy, which forms part of these Terms.

9. Suspicious Activity & Account Suspension

We may suspend, restrict, or block your account, with or without notice, if we reasonably believe you have engaged in fraud, payment abuse, attempts to bypass usage limits, or the upload or generation of prohibited content, or if your activity poses a risk to the Service or other users. We may also take these measures to comply with the law or to protect the integrity and security of the Service.

10. Disclaimers

The Service is provided on an 'as is' and 'as available' basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated results will meet your expectations. AI outputs may contain inaccuracies, and you are responsible for reviewing them before use.

11. Limitation of Liability

To the maximum extent permitted by law, Unlimited AI Images - Magical and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the 'Last updated' date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.
